In a judgment last week, the Federal Court clarified an important aspect of the Building Code 2016 that may have implications for some members. The clarification relates to the display of building association logos, mottos and indicia on construction sites for Code covered entities.
The Federal Court judgement confirmed that clause 13(2)(j) of the Code prohibits building association materials being attached to clothing, equipment of property where they are supplied or provided by a company.
The judgment found that Eureka flags on cranes and union posters in crib facilities were in breach of the Code.

The clarification is relevant to members that tender for and perform federally funded work. If members are Code covered entities, we remind them that breaches to the Code may lead to investigation from the ABCC and potential exclusion from federally funded work.
We recommend that our members take this clarification as a timely opportunity to review materials displayed on-site where they are Code covered entities.
