Master Builders Victoria has been notified by the Registered Organisations Commission (ROC) that it intends to commence an Inquiry, pursuant to section 330 of the Fair Work (Registered Organisations) Act 2009.
The ROC has indicated that the Inquiry will concern the compliance of Master Builders Victoria with obligations in relation to the conduct of the 2018 elections and the keeping of records.
The particulars of the Inquiry include:
- Whether Master Builders Victoria may have contravened section 230 of the RO Act by failing to keep records that are required to be kept by organisations;
- Whether Master Builders Victoria may have contravened section 231 of the RO Act by failing to keep records which are required to be kept for 7 years; and
- Any associated matters related to the conduct of office holders or employees.
This is a voluntary process and Master Builders Victoria will provide full assistance to the ROC during its Inquiry.
The ROC has also advised Master Builders Victoria that they have referred the matter to the Australian Federal Police for review of a possible contravention.
Given the Inquiry has commenced, it is inappropriate for Master Builders Victoria to discuss any further details and we will not be making an additional comment, at this point.
