Despite the Victorian Government’s decision to abolish the Construction Compliance Code and, consequentially, the mandatory requirement for drug and alcohol testing on State Government- funded construction projects, there continues to be substantial interest and activity in drug and alcohol testing in the Victorian construction industry.
In March 2015 the CFMEU national office announced they were in favour of mandatory drug and alcohol testing and that they would be seeking to have this policy required in industry agreements.
In recent months, there have been a number of significant decisions from the Fair Work Commission that have addressed employer drug and alcohol policies, and the right of an employer to undertake testing and subsequent disciplinary action.
Related to this, both State and Federal Governments have formed an ice taskforce to tackle the growing use of crystal methamphetamine, known colloquially as “ice”. Methamphetamine continues to feature heavily in the media on a regular basis and continues to create cause for concern in the context of workplace safety.
