The State Government has today announced the Victorian Fair Jobs Code (the Code).  

A promise at the 2018 election, the Code seeks to utilise the State’s purchasing power to achieve certain industrial outcomes, including secure jobs.   

The Code will apply to businesses that perform Victorian Government threshold contracts or seek a business grant above a certain value.  

State Government and its agencies will implement the Code from 1 December 2022.   

Master Builders Victoria has raised concerns about the Code with the State Government, including that it increases the already challenging regulatory burden on business and it duplicates existing requirements elsewhere.  

The Code introduces two new key requirements: 

  • A Fair Jobs Code Pre-Assessment Certificate  
  • A Fair Jobs Code Plan  

A Fair Jobs Code Pre-assessment certificate must be held by businesses seeking State Government contracts of $3 million or more, or business expansion grants of $500,000 or more.  
 
For State Government contracts of $20 million or more, businesses will need to have a Fair Jobs Code Plan in addition to the Pre-Assessment Certificate. Any subcontractors doing work on State Government projects will also need to have a Pre-assessment Certificate if the subcontract value is above $10 million.
