Public holiday payment for workers who have been stood down
Employees who are stood down by their employer under the Fair Work Act are still entitled to be paid for public holidays that fall during the stand-down period. This requirement applies only if the public holiday falls on a day that the employee would usually have worked.
In Victoria, the upcoming public holidays are:
- 10 April Good Friday
- 11 April Easter Saturday
- 12 April Easter Sunday
- 13 April Easter Monday
- 25 April Anzac Day
- 8 June Queen’s Birthday
Anzac Day update
If it would suit your business to bring the Anzac Day Paid Substitute (27th) and the RDO (28th) forward to follow the Easter Break (16 and 17 April), we suggest you follow the RDO consultation provisions within the EA and discuss your operational needs with the CFMEU.
From our discussions with the CFMEU, we understand that, where workers are supportive of such an outcome, the unions will be open to these requests, particularly given the current environment.
This may provide a ‘timely’, longer Easter Break, and provide for two weeks without an RDO following Easter. Please be mindful that Anzac Day Public Holiday (Saturday 25) will fall in this two-week period. While this is an option, there is no expectation that you should extend the Easter
